FinAUTO Terms of Service

These Terms of Service (“Terms”) govern access to and use of the FinAUTO application, website, support channels, and related services (collectively, the “Services”). “FinAUTO,” “we,” “us,” and “our” refer to the FinAUTO service operated by an individual developer based in Canada. FinAUTO is not represented as an incorporated company, bank, lender, NBFC, financial institution, financial adviser, credit bureau, or government authority.

Acceptance and Eligibility
By registering for, accessing, or using the Services, you agree to these Terms and the Privacy Policy, as applicable. Registration may require affirmative electronic acceptance, and FinAUTO may record the accepted version, date, time, and related evidence. Material changes may require renewed acceptance where legally or contractually necessary.
The Services are intended for businesses and adults. Minors may not independently create or use accounts. You must provide accurate information and must not create an account for another person without authority.
The Service
FinAUTO provides software tools for vehicle-finance and related business administration, including records, calculations, documents, permissions, offices, audit functions, subscriptions, and related features. Features may vary by plan, platform, region, and implementation.
FinAUTO does not provide lending, banking, financial advice, credit decisions, legal advice, tax advice, collection services, or government services. Users and organizations must independently verify inputs, calculations, documents, agreements, payment records, and legal requirements before relying on them.
Accounts, Organizations, and Administrators
You are responsible for the accuracy of account information and for maintaining the confidentiality of credentials, PINs, pairing codes, devices, and recovery methods.
Organization administrators may manage users, roles, offices, permissions, and organization settings according to the applicable plan and available features.
Administrators are responsible for ensuring that access assignments and management instructions are authorized.
FinAUTO may rely on instructions from authorized administrators, subject to security controls and applicable law.
Organizations are responsible for internal disputes involving owners, administrators, staff, customers, access rights, and data management. FinAUTO may restrict or suspend access where reasonably necessary for security, legal compliance, or protection of data.
Organization and Customer Data Responsibilities
Organizations and users are responsible for ensuring that they have all rights, permissions, notices, consents, lawful bases, and authority required to collect, upload, access, use, disclose, and retain information entered into FinAUTO. This includes customer KYC information, identity documents, vehicle records, bank details, loan records, images, and other personal or confidential information.
Users and organizations retain rights in information they submit. They grant FinAUTO the limited permissions reasonably necessary to host, process, transmit, secure, maintain, back up, display, and provide the Services. FinAUTO does not receive unrestricted ownership of submitted information.
FinAUTO acts solely as a passive technical host and data conduit. FinAUTO does not inspect, review, verify, pre-screen, or monitor any photographs, vehicle inspection images, identity documents, KYC files, contracts, or records uploaded by organizations or users. Organizations and users assume sole legal and financial responsibility for all uploaded images, files, and data, and FinAUTO expressly disclaims all liability for unlawful, inaccurate, infringing, fraudulent, or non-compliant content uploaded to or processed through the Services.
Acceptable Use
You must not use the Services to:
- violate law, regulation, court order, contract, privacy rights, or another person’s rights;
- commit fraud, deception, unauthorized collection, identity misuse, harassment, or abuse;
- bypass authentication, licensing, subscription, role, office, device, or security controls;
- introduce malware, conduct attacks, probe or disrupt systems, or interfere with other users;
- reverse engineer, decompile, copy, resell, lease, sublicense, or create competing services from the Services except where applicable law expressly permits it;
- upload content that is unlawful, infringing, harmful, misleading, or that you lack authority to submit;
- use FinAUTO as a substitute for professional legal, financial, tax, lending, or regulatory advice.
Calculations and Records
FinAUTO may provide flat-interest, EMI, date, penalty, reporting, or other calculation tools. Results depend on the inputs, configuration, rounding, dates, assumptions, and implementation. You must verify results and ensure that agreements and records reflect the intended transaction. FinAUTO is not a party to loans, customer agreements, collection arrangements, or disputes between users, organizations, and their customers. FinAUTO does not evaluate, monitor, or enforce compliance with statutory interest rate ceilings, usury laws, state money lending regulations, or central banking directives (including Reserve Bank of India guidelines). The user or organization warrants that all loan terms, interest calculations, recovery practices, and customer agreements comply with all applicable local, state, and national laws.
Subscriptions, Trial, and Billing
- FinAUTO may offer a 14-day free trial, subject to eligibility, plan terms, and technical availability.
- Paid plans may renew automatically or manually depending on the plan, platform, and user selection. The applicable checkout or subscription screen should disclose price, billing frequency, taxes, renewal method, and cancellation instructions.
- Google Play purchases are subject to Google Play’s payment, subscription, cancellation, and refund processes. FinAUTO-managed payments are subject to the applicable published billing terms and law.
- Prices and taxes may change. Notice and renewed acceptance will be provided where required by the payment provider, contract, or law.
- Users and organizations must maintain accurate billing information and are responsible for applicable taxes and charges associated with their use.
Cancellation, Expiration, and Suspension
Cancellation generally stops future renewal while access continues through the end of the paid billing period, unless the payment provider or applicable law requires a different result. Account deletion is separate from subscription cancellation.
There is no general grace period after paid subscription expiration. Restrictions may begin when the subscription expires. Depending on the plan and available features, access may become read-only or restricted, selected creation and modification functions may be disabled, and export or viewing may be available.
Non-payment may result in immediate suspension, subject to provider requirements and applicable law. Suspension does not automatically require deletion of data.
Refunds
Google Play purchases must generally be handled through the Google Play refund process, subject to Google’s policies and applicable law. For FinAUTO-managed payments, refunds are handled under the published refund policy, billing-error procedures, the payment arrangement, and applicable law. Statutory consumer rights are not excluded.
Data Access, Export, and Retention
Organization administrators handle export access after subscription expiration or account restrictions, where export is supported. Staff may not independently export restricted organization data unless authorized and technically permitted.
Organizations control retention of their business records. FinAUTO separately retains account, billing, security, audit, support, backup, legal, and dispute records as reasonably necessary. FinAUTO may delete eligible data under published inactive-account, retention, suspension, backup, or legal policies after reasonable notice where practical, with exceptions for legal, security, dispute, audit, and backup purposes.
Intellectual Property
FinAUTO owns or licenses the Services, software, branding, designs, documentation, and related intellectual property, except for user-submitted content and third-party materials. Third-party and open-source components remain subject to their applicable licenses. You may not remove notices, misuse FinAUTO branding, or use the Services beyond the rights granted by these Terms.
Third-Party Services
The Services may depend on third-party services, including hosting, authentication, storage, payments, email, analytics, diagnostics, and support providers. Third-party terms and policies may apply. FinAUTO is not responsible for independent acts or failures of third parties beyond its legal responsibilities and contractual obligations.
Availability and Changes
The Services are not promised to be uninterrupted, error-free, permanently available, or compatible with every device or environment. We may maintain, update, modify, restrict, suspend, or discontinue features. We will provide notice where appropriate and preserve applicable paid-subscription, material-change, and legal notice rights.
Security
FinAUTO uses reasonable safeguards but cannot guarantee absolute security. You are responsible for protecting devices, credentials, PINs, pairing codes, administrator access, and network environments. Notify FinAUTO promptly at support@myfinauto.com if you suspect unauthorized access or a security issue.
Suspension and Termination
FinAUTO may restrict, suspend, or terminate access for violation of these Terms, unlawful or abusive conduct, fraud, security threats, non-payment or expiration, legal obligations, or protection of users, organizations, or the Services. Where appropriate and legally permitted, we may provide notice and an opportunity to address the issue. Termination does not remove obligations that by their nature should continue.
Disclaimers
To the maximum extent permitted by law, the Services are provided on an “as available” and “as is” basis, subject to any non-excludable statutory rights. FinAUTO does not guarantee that calculations, records, backups, exports, notifications, integrations, or security controls will always be accurate, complete, available, or successful. Nothing in these Terms excludes a duty or right that cannot lawfully be excluded.
Liability, Liability Cap, and Non-Recourse
To the maximum extent permitted by applicable law, FinAUTO will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for loss arising from user error, unauthorized credentials, device compromise, network failure, third-party services, inaccurate inputs, internal organization disputes, or failure to maintain appropriate backups. Subject to applicable law and the exceptions stated below, FinAUTO’s aggregate liability for direct damages arising out of or relating to the Services or these Terms will not exceed the lesser of: (a) the total fees actually paid by the claimant to FinAUTO for the Services during the six (6) months immediately preceding the event giving rise to the claim; or (b) CAD $100. If no fees were paid, the cap will be CAD $100, subject to applicable law. This cap applies only to the maximum extent permitted by law and does not apply to liability that cannot lawfully be limited or excluded, including non-waivable statutory rights, intentional misconduct or fraud where non-excludable, or other categories that applicable law requires to remain uncapped.
Non-Recourse to Personal Assets
To the maximum extent permitted by applicable law, any claim relating to the Services should be brought only against the FinAUTO service operation and not against the operator’s personal bank accounts, residence, vehicle, investments, or other personal assets. This provision allocates contractual recourse and does not create a separate legal entity, guarantee enforcement, prevent a claim from being filed, or override mandatory law, insolvency rules, fraud exceptions, or other applicable exceptions. Because the operator is not currently using a corporation or other limited-liability entity, this clause must not be interpreted as providing absolute personal-asset protection.
Indemnification
To the extent permitted by law, you or your organization are responsible for claims arising from unlawful use of the Services, violation of these Terms, infringement of third-party rights, unauthorized submission or processing of information, or disputes arising from your business activities. Any indemnification obligation is subject to applicable law, reasonable claim procedures, and any limits required by law.
Governing Law, Quebec Forum, and Individual Arbitration
Subject to mandatory law and non-waivable rights, these Terms are intended to be governed by the laws of the Province of Quebec and the federal laws of Canada applicable in Quebec, without regard to conflict-of-law rules. Any dispute, claim, or controversy arising out of or relating to the Services or these Terms will, to the maximum extent legally permitted, be resolved through confidential, mandatory individual arbitration seated in Quebec, Canada, before a mutually agreed arbitrator or an arbitrator appointed under applicable arbitration legislation. Arbitration will be conducted on an individual basis only, and no class, collective, representative, or consolidated proceeding is intended where such waiver is legally permitted. Nothing prevents a party from seeking urgent interim or injunctive relief from a court of competent jurisdiction, exercising a non-waivable statutory right, bringing a claim that cannot legally be arbitrated, or pursuing a remedy that applicable law requires to remain available. Enforceability, including consumer and cross-border protections, must be confirmed by qualified Quebec counsel before publication.
Changes to These Terms
We may update these Terms as the Services, providers, laws, or business model change. The current version may be made available in the application and on the website. We may provide in-app notice and require renewed acceptance for material changes where legally or contractually required. The effective date will identify the current version.
